There are Several Important Things You Must Know if Your Child has been Detained. The juvenile justice system is different from the adult system because it combines aspects of both criminal and civil law. Although juvenile courts are similar to the adult criminal justice system in many ways, its primary goal of rehabilitating youthful offenders differs drastically from the State’s “lock ‘em up and throw away the key” method of dealing with convicted adults. Your child may find himself in trouble for any number of reasons, ranging from problems specific to kids like truancy and running away, to more grown up issues of theft, possession of marijuana or other drugs, assault, or sex crimes. The State will describe your child’s conduct as either: 1) delinquent conduct, or 2) conduct indicating a need for supervision. No matter how the behavior is described by the State, there are two things that you and your child need to know: Your Child has the Same Rights as an Accused Adult. That means that your child has the right to remain silent, the right to confront the witnesses against him and question the evidence. Most importantly, it means that the State must be able to prove beyond a reasonable doubt that your child committed the behavior in question.
